Terms of Sale

1. Purpose and scope
These Terms of Sale (the "Terms") govern the subscription to the Cerulean mobile application (the "App"), published by Camille Terol, sole trader (entrepreneur individuel) trading as “Interrupt” (the "Publisher"). Cerulean is a native iOS app and an independent third-party client for Azure DevOps, enabling work-item management and pull-request tracking from the user's own Azure DevOps organisation. The App is intended for both consumers and professionals.
2. Distribution via the App Store and Apple's role
The App is distributed exclusively through the App Store operated by Apple Distribution International Ltd (Hollyhill Industrial Estate, Hollyhill, Cork, Ireland) for the relevant markets. The purchase and sale of the subscription are carried out by Apple, acting as merchant of record. Accordingly, Apple manages the transaction, billing, collection of payment and the handling of refund requests, under its own terms (Apple Media Services Terms and Conditions). The Publisher grants a licence to use the software; it does not collect payment directly and does not collect any payment data.
3. Price
The subscription is offered at USD 14.99 incl. tax per year (GBP 9.99 / EUR 9.99 / local equivalent depending on the market). The price displayed on the App Store at the time of purchase prevails and may vary by market and currency. Applicable taxes are managed and collected by Apple based on the user's country.
4. Auto-renewable subscription
- The subscription is an annual auto-renewable subscription with a term of twelve (12) months.
- Payment is charged to the user's Apple Account upon confirmation of purchase.
- The subscription renews automatically for successive twelve (12)-month periods at the then-current price, unless cancelled at least twenty-four (24) hours before the end of the current period.
- The account is charged for renewal within 24 hours prior to the end of the current period.
5. Cancellation and subscription management
Users can manage their subscription and turn off auto-renewal at any time in their App Store account settings (iOS Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current period: access continues until that date, with no refund for the period already started, subject to mandatory legal provisions. Refund requests are handled by Apple at reportaproblem.apple.com.
6. Right of withdrawal and waiver (digital content)
Under Articles L.221-18 et seq. of the French Consumer Code, consumers have, in principle, a fourteen (14)-day right of withdrawal without giving reasons.
Digital-content exception: under Article L.221-28 13° of the French Consumer Code, the right of withdrawal does not apply to the supply of digital content not on a tangible medium where performance has begun with the consumer's prior express consent and express acknowledgement of the loss of the right of withdrawal. By subscribing and accessing the App immediately, the user expressly requests immediate performance of the service and acknowledges losing the right of withdrawal once the service is fully performed. Any refunds remain handled by Apple.
7. Legal warranties
Independently of any commercial warranty, consumers benefit from:
- the legal warranty of conformity for digital content and services (Articles L.224-25-1 et seq. of the French Consumer Code);
- the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).
Under these warranties, the consumer may obtain that the digital content be brought into conformity. Claims may be sent to the Publisher (see section 11), without prejudice to remedies available from Apple as merchant of record.
8. Availability and updates
The App is provided as is and receives regular improvements included in the subscription. Proper operation requires a compatible iOS device, an internet connection and valid access to an Azure DevOps organisation. The Publisher is not liable for interruptions or unavailability attributable to Azure DevOps, Microsoft, Apple, the user's network or any third party.
9. Liability
The Publisher is bound by a best-efforts obligation. It is not liable for indirect damages or for damages resulting from improper use of the App, misconfiguration of the user's Azure DevOps organisation, or loss of an access token. Nothing in these Terms limits the Publisher's liability where the law prohibits such limitation, in particular towards consumers.
10. Governing law and dispute resolution
These Terms are governed by French law. The App is sold exclusively by Apple, acting as the merchant of record; it is never sold directly to consumers by the Publisher. Refund and dispute requests are handled by Apple (reportaproblem.apple.com) under Apple's Media Services Terms. Accordingly, the designation of a French consumer mediator, which applies to direct sales between a business and a consumer, does not apply.
Consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Failing an amicable settlement, the French courts have jurisdiction as provided by law.
11. Claims and contact
Any claim regarding the App may be sent to the Publisher: [email protected]. Claims regarding payment, billing and refunds are handled by Apple.
12. End User License Agreement (EULA)
Use of the App is governed by Apple's standard Licensed Application End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula, unless a specific licence agreement is provided with the App.
